2. Service description

Darkpoollv is a digital real estate crowdlending platform that facilitates the connection between participants interested in property projects in Bolivia. The platform provides information about real estate projects, participation management tools, and investment tracking.

Darkpoollv acts as a technological intermediary and does not guarantee specific returns nor assumes responsibility for the individual performance of projects presented on the platform. All participation involves risks inherent to the real estate market.

3. Registration requirements

To access certain platform services, it is necessary to create an account providing truthful, complete, and up-to-date information. You must be of legal age under Bolivian law (18 years) and have legal capacity to contract. You are responsible for maintaining the confidentiality of your access credentials and all activities carried out under your account.

4. Acceptable use

You agree to use the platform lawfully and in accordance with these terms. It is prohibited to use the platform for fraudulent, illegal activities, or those that violate third-party rights, attempt unauthorized access to platform systems, data, or networks, disseminate malicious or misleading content that infringes intellectual property rights, and use automated mechanisms to extract data from the platform without prior authorization.

5. Investment risks

Participation in real estate crowdlending projects carries risks, including the possibility of partial or total loss of invested capital. Past returns do not guarantee future results. Before participating in any project, we recommend carefully evaluating your financial situation and consulting with professional advisors.

6. Intellectual property

All platform content, including texts, graphics, logos, images, software, and their compilation, is the property of Darkpoollv S.R.L. or its licensors and is protected by the intellectual property laws of the Plurinational State of Bolivia and applicable international treaties. No license is granted over these rights except as expressly indicated in these terms.

7. Limitation of liability

Darkpoollv provides the platform "as is" and "as available." To the maximum extent permitted by Bolivian law, Darkpoollv shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the platform.

Our total liability to you for any claim related to these terms shall not exceed the amount you have paid to Darkpoollv for services during the twelve months prior to the event giving rise to the claim.

8. Applicable law and jurisdiction

These Terms and Conditions are governed by the laws of the Plurinational State of Bolivia. Any dispute arising from these terms shall be submitted to the jurisdiction of the competent courts of the city of La Paz, Bolivia, with the parties waiving any other jurisdiction that may correspond to them.

9. Modifications

We reserve the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the platform. It is your responsibility to periodically review these terms to stay informed of any changes.
